Negligence — from the Latin negligentia, from neglegere, to neglect, literally "not to pick up something" — is a failure to exercise the care that a reasonably prudent person would exercise in similar circumstances. The area of civil law known as negligence involves harm caused by carelessness, not intentional harm.

According to Jay M. Feinman of the Rutgers University School of Law, "The core idea of negligence is that people should exercise reasonable care when they act by taking account of the potential harm that they might cause to other people."

When applied in a legal sense, negligence takes various forms depending on if there was wilful intent, whether it was the result of a direct or indirect action or the extent of the negligence (slight or gross negligence for instance) among other things.

Some court cases involving negligence have been questioned by the public as to whether they are superfluous or exaggerated. A man in New York sued two real estate companies for negligence for instance. Because the bathroom door in a building owned by the companies was missing a door knob, the man stuck his thumb in the hole and injured it when a person on the other side opened the door.

Should the man have know better than to stick his thumb in the hole? Should the real estate company have made sure that the door was repaired? The court awarded the man nearly $3 million. You be the judge.
