The term bootleg goes back to the so-called Prohibition, a period during the 20s and 30s when the entire U.S. went "dry" by banning the production and sale of alcoholic beverages. A broad range of organizations led the fight to institute Prohibition by linking social ills such as divorce and family abuse to the use of alcohol. Some even viewed this as a patriotic act because there were many breweries owned by German Americans.

Far from curing social problems, Prohibition led to increased organized crime activity and the creation of so-called speakeasies (establishments that illegally sold alcohol) as well as bootlegging, which originally referred to the illegal transport of alcohol.

The term itself derives from the idea of hiding a bottle in one's boot to keep it out of sight. It meanwhile is used to describe producing, copying or selling any type of product without permission. Recording a live concert and then distributing either the video or audio is considered bootlegging as an example. Still, Internet sites such as YouTube have millions of such recordings available.

The Mafia has a long history of bootlegging. The famous New York mobster Lucky Luciano had regrets about his illegal activities. When asked if he would do it again, he replied: "I'd do it legal. I learned too late that you need just as good a brain to make a crooked million as an honest million. These days you apply for a license to steal from the public. If I had my time again, I'd make sure I got that license first."
